These Terms of Service govern use of kvmservice.com and services supplied by KVM Service. A signed proposal or agreement controls where it states different terms.
1. Acceptance — By using this website or ordering services, you confirm that you have read and agree to these terms.
2. Eligibility — You must have legal capacity and authority to act for yourself or the organisation you represent.
3. Lawful use — You must not attack, disrupt, misuse, scrape protected data, upload malicious code, impersonate others, or violate any law or third-party right.
4. Enquiries — A form submission or discussion does not require KVM Service to accept work and does not create a client relationship by itself.
5. Project agreement — Scope, deliverables, schedule, fees, milestones, support, acceptance, and ownership will be defined in a written proposal or contract.
6. Customer responsibilities — You must provide accurate requirements, lawful materials, authorised access, decisions, feedback, and approvals within reasonable time.
7. Fees and payment — Prices, currency, taxes, deposits, and due dates appear in the applicable proposal or invoice; overdue payment may pause work or delivery.
8. Scope changes — Additional requests or changed assumptions may require written approval, revised fees, and a revised delivery schedule.
9. Intellectual property — Pre-existing property remains with its owner; final custom deliverables transfer only as agreed in writing and after full payment.
10. Reusable and third-party components — KVM Service retains general know-how, methods, templates, and tools; open-source and third-party items keep their own licences.
11. Confidentiality — Each party will reasonably protect non-public business and technical information and use it only for the agreed relationship, unless disclosure is legally required.
12. Availability and warranties — We provide services professionally, but the public website is offered as available and no system can be guaranteed error-free or uninterrupted.
13. Liability — To the extent permitted by law, indirect or consequential losses are excluded, and direct liability is limited as stated in the applicable written agreement.
14. Suspension and termination — We may suspend access or work for security risk, unlawful conduct, material breach, or non-payment; contract terms govern final handover and charges.
